OFFICIAL RULES

Open to residents of Canada

  1. NO PURCHASE IS NECESSARY. The Care Club Giveaway Contest (the “Contest”) is intended to be conducted in Canada only and shall be construed and evaluated according to applicable Canadian law. Void in whole or part where prohibited by law. Entry into this Contest constitutes acceptance of and agreement to abide by these official rules (the “Official Rules”). Do not participate in the Contest if you do not fall within the eligibility requirements as set forth in Rule 3. The decisions of the Sponsor (defined below) with respect to all aspects of the Contest are final. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy https://www.kenvue.com/privacy-policy/canada/en
  2. SPONSOR & CONTEST PERIOD: The Contest is sponsored by Johnson & Johnson Inc. (also doing business as “Kenvue”) (the “Sponsor”) and is administered by Promotion Solutions (the “Administrator”). The Contest begins at 12:00:01 AM Eastern Time (“ET”) on April 19, 2024 and ends at 11:59:59 PM ET on May 20, 2024 (the “Contest Period”).
  3. ELIGIBILITY: To enter and be eligible to win, an entrant (an “Entrant”) must be a legal resident of Canada who at time of entry has reached the age of majority or older in the province/territory in which they reside and be a member of the Care Club Canada or register to become member of Care Club Canada, and agree to receive commercial electronic messages from the Sponsor, which may be done at time of entering the Contest (see Rule 4). Entrants can withdraw their membership in Care Club Canada and permission to receive commercial electronic messages from the Sponsor at any time, without affecting their eligibility or chance to win in this Contest. Employees, officers, directors, representatives, and agents  of the Sponsor, the Administrator and each of their respective  affiliates, subsidiaries, related companies, advertising and promotional agencies, entities involved in the development, production, administration, or fulfillment of the Contest, the National Hockey League (the “NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P. NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities, collectively, the “NHL Entities”) and the family members and household members of any of the above, are not eligible to participate in the Contest. In these Official Rules, “family member” means the Entrant's mother, father, brother, sister, son, daughter or legal or common-law spouse, “household member” means anyone domiciled in the same residence, whether related or not. The Sponsor and Administrator shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor and Administrator for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor and Administrator reserve the right, in their sole discretion, to disqualify any Entrant should such an Entrant at any stage (i) supply untruthful, incomplete, inaccurate or misleading personal details and/or information, or (ii) fail to strictly adhere to these Official Rules.
  4. HOW TO ENTER THE CONTEST: During the Contest Period, visit www.careclubgiveaway.ca (the “Contest Website”) and complete the entry form with your first and last name, daytime telephone number, a valid email address and your postal code. Next, confirm that you have read and accept these Official Rules, tick the opt-in box to register for the Care Club Canada and agree to receive information from the Sponsor regarding upcoming events and/or promotions. You may unsubscribe at any time without affecting your chances of winning. Upon doing so, click “Submit” to receive one (1) entry (the “Entry”, collectively, “Entries”) into the Contest. All Entries become the sole property of the Sponsor and none will be returned for any reason. Entries must be received on or before 11:59:59 PM ET on May 20, 2024 (the “Contest Closing Date”).

    By clicking “Submit” you are (i) registering for the Care Club Canada (if you are not already a member and which you may unsubscribe from after entering the Contest and will not affect your eligibility to win the Prize), (ii) confirming compliance with these Official Rules and (iii) confirming that you are the age of majority or older at time of entering the Contest. There is no cost associated with registering for the Care Club Canada. You may unsubscribe from receiving these Communications at any time. Should you choose to unsubscribe during the Contest Period, your Entry will continue to be valid as long as it meets all other criteria required by these Official Rules. If you have previously unsubscribed from Communications from Sponsor, you will be re-added to Sponsor’s email list.

    You may only use one (1) email address to enter the Contest. Limit of one (1) Entry per person during the Contest Period. Anyone found to have used multiple email accounts to enter will be ineligible. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. All Entries are subject to verification. The Sponsor and Administrator reserve the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification.

    In the event it is determined that an Entrant has entered in a fashion not sanctioned by these Official Rules and/or has submitted more than the number of Entries permitted by these Official Rules, the Entrant will be disqualified and all of the Entries submitted by the Entrant will be disqualified.
  5. PRIZE: There is one (1) prize (the “Prize”) available to be won, consisting of a trip for two (2) people (the winner and their travel guest) to attend a 2024 Stanley Cup® Final game (the “Event”) as selected by the Sponsor (subject to availability at the sole discretion of the Sponsor) scheduled to be held in June 2024, in a city located in either Canada or the United States (specific travel dates and Event city will be determined at a later time and will be confirmed by the Sponsor in its sole discretion). The Prize consists of round-trip economy airfare for two (2) people departing from the International Airport nearest the winner’s residence in Canada (determined by Sponsor in its sole discretion) to the Event city; two (2) nights’ hotel accommodation as selected by the Sponsor in a standard room based on double occupancy in the Event city; two (2) general admission tickets to attend a 2024 Stanley Cup® Final game as selected by the Sponsor (seating locations as determined by the Sponsor in its sole discretion) and $2,000.00 CDN spending money which may be used for expenses such as meals and ground transportation in the Event city (or other expenses incurred by winner to travel to the International Airport nearest the winner’s residence in Canada) issued in the form of a cheque payable to the winner as their name appears on the Release Form (as defined in Rule 7).

    Approximate retail value (“ARV”) of the Prize is $20,900.00 (CDN) based on a sample round-trip flight for two (2) adults from Toronto, ON to Los Angeles, CA. Actual value may vary based on airfare fluctuations and distance between departure and destination. Any difference between the ARV and the actual value of the Prize as awarded will not be provided. The Prize must be accepted as awarded, is not transferable and not for sale.

    The Sponsor reserves the right, in the event that the Prize or any component of the Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. The winner and their travel guest must depart from and return to the International Airport nearest to the winner’s home in Canada and must travel on the same itinerary. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. The travel guest must be a legal resident of Canada. The winner and their travel guest must have the appropriate identification required for airport check-in and will be responsible for having all required travel documents, including a valid passport (valid for at least the period required to allow travel to the Event city, typically a minimum six (6) months left before expiration (though the winner must verify the requirements themselves)) as required by law and any other applicable travel documents at their own expense, or the Prize will be forfeited. The winner and their travel guest must be legally able to travel to the United States and back into Canada or within Canada (if required). The winner and their travel guest will be responsible for any required ground transportation, tips, gratuities, meals, entertainment, merchandise, souvenirs, local and long distance telephone calls, taxes, travel visas, hotel services if applicable (unless otherwise covered in the Prize as expressly identified in the Prize description above), travel, medical, baggage and cancellation insurance, additional spending money, personal expenses, incidentals and all other expenses that are not expressly covered by the Prize description stated above. No changes after booking are permitted and if the winner is not able to travel after booking, no re-booking dates will be granted and the Prize will be forfeited. The winner will be required to present a valid major credit card in their name at the time of hotel check-in to cover any incidental expenses. Booking is subject to availability of flights and hotel accommodation, government restrictions and regulations, hotel, airline, airport and other transportation restrictions and regulations. No responsibility is assumed by the Sponsor for cancelled, delayed, suspended or rescheduled travel for any reason. All travel arrangements must be made through the Sponsor or its designated agent. No frequent flyer miles or similar reward program will be awarded for any trip. If the winner is unable to participate in the trip during the dates designated by Sponsor, the Prize will be forfeited in its entirety.  In the event the winner is able to participate in the trip during the dates designated by Sponsor, but the Event does not (or cannot) take place as scheduled or at all, for reasons including, but not limited to, scheduling conflicts, epidemic/pandemic, act of God, weather, cancellations, postponements, or for any other reason, then the Sponsor reserves the right to award the remainder of the Prize in full satisfaction of the Prize award with no further obligation to the winner. Resale of NHL® Event tickets is prohibited. The winner and their travel guest must abide by all venue policies and Event ticket terms and conditions, failing which they may be ejected from the venue and no compensation will be provided. The Sponsor reserves the right to revoke the full or partial prize from the winner or their travel guest who the Sponsor or venue personnel deem, in their sole discretion may be intoxicated, be a safety risk, have violated any venue policy or law, or who may bring the Releasees (see Rule 7) into disrepute. In the event that the confirmed winner resides within a three hundred (300) km radius of the Event city (as determined by the Sponsor in its sole and absolute discretion), the Sponsor will determine, in its sole and absolute discretion, whether or not the Prize will include airline travel, another form of transportation to and from the Event city, or reimbursement for certain incurred fuel costs. All decisions of the Sponsor in this regard will be final and binding without right of appeal.

    Travel Guest Requirements: The confirmed winner’s travel guest must be a legal resident of Canada and must also complete and return the Administrator’s form of properly-executed travel guest Release Form within the time specified by the Administrator. In the event the travel guest is under the age of majority (a ‘Minor”), they must; (i) be the child of the Prize winner; (ii) have their parent or legal guardian sign and return the Administrator’s Release Form (by the date indicated on the Release Form) indicating (among other things) that they waive all recourse against the Releasees (see Rule 7) relating to their participation in the Prize (including, without limitation, any travel related thereto).
  6. PRIZE DRAW: A random draw (the “Draw”) will be held at approximately 2:00 PM ET on May 21, 2024 (the “Draw Date”) at the offices of the Administrator at 2390 Bristol circle, unit 3 in Oakville, Ontario, from all eligible Entries received during the Contest Period. Odds of being selected for the Prize depend on the number of eligible Entries received during the Contest Period. The selected Entrant will be contacted by email or telephone within two (2) business days of the Draw Date. If the selected Entrant (a) cannot be reached within two (2) business days of being contacted, (b) fails to correctly answer the skill-testing question (see Rule 7); or (c) fails to return the properly-executed Release Form within the specified time (see Rule 7), then they will be disqualified and, time permitting, at the sole and absolute discretion of the Sponsor, another Entrant will be randomly selected (in which case the forgoing provisions of this section shall apply to such new selected entrant). The Sponsor will not be responsible for failed attempts to contact a selected Entrant.
  7. WINNER CONFIRMATION: To be declared the Prize winner, the selected Entrant must correctly answer without assistance of any kind a mathematical skill-testing question. If the selected Entrant fails to correctly answer the skill-testing question, then they will be disqualified and another Entrant may in the discretion of the Sponsor and time permitting, be randomly selected, (in which case the foregoing provisions of sections 6 and 7 shall apply to such new selected entrant). The selected Entrant must also sign and return within two (2) business days of notification the Administrator’s form of declaration of eligibility and a liability/publicity release (the “Release Form”), which (among other things): (a) confirms compliance with these Official Rules; (b) acknowledges acceptance of the Prize as awarded; (c) releases the Sponsor and Administrator, their respective  affiliates, subsidiaries, related companies, advertising and promotional agencies, entities involved in the development, production, administration, or fulfillment of the Contest, the NHL Entities (defined in rule 3) and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of the Prize, including but not limited to, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and grant to the Sponsor the unrestricted right, in the Sponsor’s discretion, to use and re-use the winner’s name, photograph, likeness, voice and biography in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The travel guest must also complete and return a properly-executed travel guest Release Form in the form provided by the Administrator within the time specified by the Administrator. In the event the travel guest is under the age of majority, their parent or legal guardian must sign and return the Administrator’s travel guest Release Form (by the date indicated on the guest Release Form) indicating (among other things) that they waive all recourse against the Releasees (as defined above) relating to their participation in the Prize (including, without limitation, any travel related thereto). Upon receipt and verification of the duly-signed Release Forms by the Administrator, the Prize will be coordinated with the confirmed winner by the Administrator. Only one (1) Prize will be awarded.
  8. DATA PRIVACY. Any information provided by the Entrant to the Contest Website is collected by the Administrator and governed by the Sponsor’s Privacy Policy, which can be found at https://www.kenvue.com/privacy-policy/canada/en. By entering the Contest, an Entrant grants Sponsor, Administrator, and their respective affiliates the right to use the information provided by the Entrant for the purposes of administering the Contest and in any publicity and promotions related to the Contest. Entrant personal information will be used by Sponsor, Administrator and their third party service providers inside and outside Quebec & Canada. By entering the Contest, Entrant consents to the transfer of their data to jurisdictions outside their province and/or country of residence, which may have different data protection rules governing their personal information. If an Entrant opts-in to receive promotional emails from the Sponsor, the Sponsor may use the information provided to contact the Entrant to provide marketing communications. Entrant may unsubscribe from receiving these communications at any time by clicking the link in any email sent by the Sponsor.
  9. GENERAL: The Sponsor will not be liable for any failure of the Contest Website, does not assume any responsibility for any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the Internet or at any website and assumes no liability for damage to Entrant's or any person's computer resulting from participating in the Contest. The use of an invalid email address will disqualify the Entry. Users spamming/reusing the same email address will disqualify all associated Entries. In the event of a dispute as to the identity of the winner based on an email address, the selected Entry will be deemed to have been made by the authorized account holder of the email address at the time of entry. “Authorized account holder” is the natural person who is assigned an email address by an internet service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Administrator’s Contest server machine(s).
  10. This Contest is subject to all applicable federal, provincial/territorial and municipal laws and regulations. By entering the Contest, participants agree to (i) be bound by these Official Rules and by the decisions of the Sponsor and Administrator, which shall be final with respect to all matters relating to this Contest and the awarding of the Prize and (ii) release the Releasees (see Rule 7) from any and all liability in connection with this Contest, the selected Entrant’s participation therein and/or the awarding and use/misuse of the Prize or any portion thereof. All Entries become the property of the Sponsor and none will be returned. The Releasees make no warranty, guaranty of any representation of any kind concerning the Prize, disclaim any implied warranty, and are not liable for injury, loss, or damage of any kind resulting from the acceptance or use/misuse of the Prize (including any travel related thereto) or from participation in this Contest.
  11. The Sponsor is not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner, or the distribution of the Prize. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to the Prize and/or point of sale, print or online advertising; the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
  12. If for any reason, the Contest is not capable of being completed as planned including, but not limited to computer virus, bugs, tampering, technical failures or other causes beyond the control of the Sponsor, the Sponsor and Administrator reserve the right to modify the Official Rules or cancel this Contest and conduct the Draw from all previously-received eligible Entries received by the date of cancellation of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
